Payment processing

If you initiate a payment process, you must enter additional data. What data you have to enter depends on the type of payment method you have chosen. We allow you to use anonymous payment methods.

We transmit the data required for payment processing to service providers who are commissioned to collect the fee. For this purpose, we have carefully selected the service provider Adyen GmbH, PayPal, and PPRO and concluded an order processing contract with them in accordance with the requirements of the EU Data Protection Basic Regulation. This ensures secure data processing in compliance with data protection regulations.

Cooperation with third parties also involves payment processing via external service providers (Paypal, credit card companies, mobile network operators, etc.). These third parties are legally bound to manage your personal data confidentially and securely in accordance with statutory legislation and may only use your personal data to fulfill their contractual obligations. You can choose the respective service provider and decide voluntarily for or against a payment method.

When you initiate a payment during the game, a cookie will be set that contains a randomly generated ID number. This cookie will be required to return you to the game once the payment process has been completed.

We employ employees who ensure the proper processing of the payment processes that have been initiated and who have access to the necessary data for this purpose. These employees act solely in accordance with our instructions and are specifically obliged to comply with data protection regulations. Such employees use anonymous payment data to detect and prevent any misuse of the payment processes. In the event of a violation, the payment process will be canceled.

We are entitled to make data available to third parties to whom we have assigned claims against the user or who are commissioned to collect the fee, insofar as this is necessary for the fulfillment of the claim or the collection of the fee.

Payment Policy

You are responsible for providing complete and accurate billing and contact information and notifying us of any changes to such information. Any payments made via wire transfer must include the bank information. You agree that you have all necessary rights, power, and authority to authorize each such payment. You agree to maintain sufficient funds or credit availability in your payment method to satisfy or deliver your amounts due and that Crypto Pirates reserves the right to suspend your Service Account or access to the Services if sufficient funds or credit availability are not available or delivered at the time your payment is submitted, or if your payment is late.

Fees and Payment policy

As between us, you will be solely responsible to pay any sales, use, value-added, and other taxes, duties, and assessments (except taxes on our net income) now or hereafter claimed or imposed by any governmental authority (collectively, “Taxes”) associated with your use of the Crypto Pirates (including, without limitation, any Taxes that may become payable as the result of your ownership, transfer. Except for income taxes levied on Crypto Pirates, you: (i) will pay or reimburse us for all national, federal, state, local, or other taxes and assessments of any jurisdiction, including value-added taxes and taxes as required by international tax treaties, customs or other import or export taxes, and amounts levied in lieu thereof based on charges set, services performed or payments made hereunder, as are now or hereafter may be imposed under the authority of any national, state, local or any other taxing jurisdiction; and (ii) shall not be entitled to deduct the amount of any such taxes, duties or assessments from payments made to us pursuant to these Terms.

Purchasing Credits

All payments by you via any payment method are done so at your own risk. Crypto Pirates expressly denies any liability regarding the purchase offered through the Crypto Pirates.

You warrant that: i. You are 18 years of age or over. ii. The payment account or cryptocurrency wallet used by you in connection with purchasing Credits is issued in your name or you are authorized to use the Paypal account, other fiat currency payment account, or cryptocurrency wallet or credit card. iii. The information supplied by you is true and correct.

All payments are debited to Crypto Pirates. Due to the way transactions are processed by our fiat currency payment processors as well as cryptocurrency payments via the blockchain, there may be delays in receiving your purchases.

Each transaction shall be subject to these Terms and Conditions in place at the time of the transaction for use in the Crypto Pirates. Any use outside of these transactions is expressly prohibited and will result in Crypto Pirates prohibiting your account from being able to purchase anything in a game.

All users are strictly prohibited from using Credits to purchase items in Splinterlands from their own accounts (or separate accounts that they control) in an attempt to receive any form of cryptocurrency in exchange. To do so is an express violation of these Terms and Conditions, and Splinterlands expressly denies any and all liability regarding these types of transactions.

In the event Crypto Pirates discovers any attempt to do so by a user, it reserves the right to prohibit the user’s account from accessing the game website and/or mobile application as well as any ability to purchase in a game.

Crypto Pirates, at its own discretion, reserves the right to implement transaction limits for purchasing on any user. Crypto Pirates reserves the right to implement limitations on the number of purchases any player may use for purchasing items in the game and/or from other players.

Refunds policy

Due to the irrevocable nature of the blockchain, and our lack of control over user assets, we are unable to offer refunds on any purchases.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our Platforms or to your downloading of any content on it, or on any website linked to it.

Termination

You may terminate these Terms at any time by canceling your account in Crypto Pirates and discontinuing your access to and use of Crypto Pirates. You will not receive any refunds if you cancel your account, or otherwise terminate these Terms. You agree that we, in our sole discretion and for any or no reason, may terminate these Terms and suspend and/or terminate your account(s) for the Crypto Pirates. You agree that any suspension or termination of your access to the Crypto Pirates may be without prior notice and that we will not be liable to you or to any third party for any such suspension or termination. If we terminate these Terms or suspend or terminate your access to or use of the Crypto Pirates due to your breach of these Terms or any suspected fraudulent, abusive, or illegal activity, then termination of these Terms will be in addition to any other remedies we may have at law or in equity. Upon any termination or expiration of these Terms, whether by you or us, you may no longer have access to information that you have posted on the Crypto Pirates or that is related to your account, and you acknowledge that we will have no obligation to maintain any such information in our databases or to forward any such information to you or to any third party.
